Terms and Conditions, The Digestible Way

We don’t want to complicate the creative process any more than we need to, but this is here for you as much as it is for us.

Payments

Website design: Schawel begins work once a down payment has been made. Generally this is 50%, but can be modified according to client requests. The entire amount is also due before all assets are migrated to clients server or sent to the client via email.

SEO / SEM services: We collect payment for all AdWords and SEO stand-alone services at the beginning of each month and each month therefter for the full legth fo the term; be that 6 months or 12 months.

On-site instruction & courses: We bill the entire course amount upfront before any instruction is done. We also bill the client all travel related expenses which include but are not limited to lodging, travel, and fees accumulate along the way.

All payments are final. There are no refunds for the simple fact that you, the client, can’t refund our time.

Delays

Delays in project completion may occur when:

  • There is a delay in any payments
  • The client requests further work, including changes in the scope, design, structure, or content of the project
  • The client purchases an additional service related to the project
  • There is a delay in the receipt of any materials or information from the client

Time frame estimates are approximate only and are subject to change at any time at Schawel’s discretion.

Indemnification

Schawel will under no circumstances be held responsible to satisfy unreasonable expectations or requests that lie beyond the scope of our offer of services to its client. It is Schawel’s discretion to decide whether or not a request or an expectation is reasonable or lies within the scope of offer of services to its client. In other words, Schawel will make all the necessary efforts to satisfy the client within the framework of its original agreement with the client, according to our understanding.

Schawel doesn’t assume any responsibility or liability for the content of the websites it designs and/or hosts. Schawel has no ownership over any information, materials, or products found thereon. Clients are entirely responsible for all that is found in their websites.

Project Management

As a client of Schawel, you will have access to all your project assets and communciation through our secured, online project management tool; BasecampHQ. You will also have access to all invoices and payment histories through our online invoice/payment tracking system; Freshbooks.

It is important to understand that we cannot make our project resources available to a project indefinitely as we have other obligations. If a project stalls or a client becomes unresponsive for more than 3 weeks, the project will become “inactive” and a re-engagement fee of 15% of the total project cost will be assessed upon re-initiating the project. If there is no meaningful activity for 3 months the project may be terminated without refund.

All prices appearing on this site are subject to change without notice. These prices are solely informative and Schawel is not necessarily committed to them for your project. Only with some healthy dialogue can we accurately quote your project. To receive a free quote for your project, please contact us.

Our Work

We reserve the right to include some small text stating “Website Design by Schawel” at the bottom of every web page created (programmed or designed) by Schawel.

Schawel may, at his sole discretion, choose to showcase on Schawel.com projects the Schawel team has worked on, or is working on, including screenshots, a link to the live website, a summary of Schawel’s role in regards to the project, etc. The client must understand and agree that we are in no way committed to displaying, or linking to, their website(s) or online project(s) on our website, but that we may choose to do so, at our sole discretion.
